Terms of Service (“Terms”)
Welcome to Urletter! Before you start using urletter.io, we kindly recommend you to read our Terms of Service (“Terms, “Terms of Service”) carefully. Urletter will be referred as “we” or “us”.
These Terms apply to all visitors, users and others who wish to access to or use the service. If you are accessing to or using us, you agree to be bound by these Terms. If you disagree with any part of the terms, then you cannot access us.
The materials on Urletter’s website are provided on an “as is” basis. We make no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose or other violation of rights.
Further, we do not warrant of make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
Limitations of Liability
In no event will Urletter, nor its director, employees, partners, agents, suppliers, or affiliates, be liable to any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible loses, resulting from your access to or use of or inability to access or use Urletter, any conduct or content of any third party of Urletter, any content obtained from Urletter and unauthorized access, use or alteration of your transmissions of content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
You must be over 13 years of age to use us. Children under the age of 13 cannot use or register for us. If you over 13, you can register us. But you cannot form a legal contract (until, according to many jurisdictions, 18). Then, you must get your parent or guardian to read these Terms and agree to them for you before you. If you are a parent or guardian and you provide consent to your child’s registration with us, you agree to be bound by these Terms with respect to your child’s use of us.
You agree your purchases and/or use of us are not contingent on the delivery of any future functionality or features or dependent on any vocal or written public comments made by us or any of our affiliates regarding future functionality or features.
For our products that have a paid plan, there is a subscription option. If you choose this option, you will be billed in advance and on a recurring basis. Billing cycles are set on a monthly basis.
At the end of each month, your subscription will automatically renew under the exact same conditions, unless you cancel it or we cancel it or Paddle cancels it. You may cancel your subscription renewal by contacting the Urletter team.
A valid payment method, including credit card and PayPal, is required to process your payment. Payments are received by Paddle, which acts as our reseller. You have to provide Paddle with accurate and complete billing information, including full name and a valid payment method.
You will be notified before your subscription is due. If your automatic billing fails for any reason, Paddle will send you a notification via e-mail. Then you can make your payment manually. If the payment does not occur, you will be reminded two more times. If one week is over without payment, your subscription will be canceled and you will be a free user.
Modification and Termination of Subscriptions
You may terminate these Terms at any time by canceling your account. In such cases, you will not receive any refunds, but you can use the site until your subscription due.
You agree that Urletter, in its sole discretion and for any or no reason, may terminate your account or any part there of. You agree that any termination of your access to Urletter may be without prior notice, and you agree that Urletter will not be liable to you or any third party for such termination.
If you cancel your account, you are solely responsible for exporting your content from Urletter. If we terminate your account, we will give you a reasonable opportunity to retrieve your content.
Upon any termination of your account, these Terms will also terminate, but all provisions of there Terms, which, by their nature, should survive termination, will survive termination, including, without limitation, ownership provisions, warranty disclaimers, and limitations of liability.
At any time and without notice, Urletter preserves to right to modify the terms and conditions of the free plan or cancel it altogether.
You agree that Urletter, in its sole discretion and at any time, may modify the subscription fees. Any change in subscription fees will become effective at the end of the then-current billing due.
We will send you a notification about any change in subscription fees in advance so that you will have the opportunity to terminate your subscription before such change becomes effective.
Your continued use of Urletter after the subscription fee change comes into effect constitutes your agreement to pay the modified subscription fee amount.
Certain refund requests for subscription may be considered by Urletter on a case-by-case basis and granted in sole discretion of Urletter.
Content and User Content
A variety of information, reviews, recommendations, messages, comments, posts, text, graphics, software, photographs, videos, data and other materials (“Content”) may be made available through the services by Urletter.
You acknowledge that you will be able to create, transmit, publish or display information (such as data files, written text computer software, music, audio files or other sounds, photographs, videos or other images) through use of the services. All such information is referred as “User Content”.
You agree that you are solely responsible for (and that Urletter has no responsibility to you or to any third party for) any User Content, and the consequences of your actions (including any loss of damage which Urletter may suffer) in connection with such User Content.
If you are registering for these services on behalf of an organization, you also agree that you are also responsible for the actions associated with users and for any User Content that such associated users might upload, record, publish, post, link to, or otherwise transmit or distribute through the use of Urletter.
Furthermore, you acknowledge that Urletter does no control or actively monitor Content uploaded by users and, as such, does not guarantee the accuracy, integrity or quality of such Content.
You acknowledge that by using Urletter, you may be exposed to materials that are offensive, indecent or objectionable. Under no circumstances will Units be liable in any way for any such content.
You will be solely responsible for the nature, quality, and accuracy of your User Content; ensure that your User Content, including the storage or transmission thereof, complies with these Terms and any and all applicable laws, and regulations; promptly handle and resolve any notices and claims relating to your User Content, including any notices sent to you by any person claiming that any User Content violates any person’s rights, such as take-down notices pursuant to the Digital Millennium Copyright Act and any other notices; and maintain appropriate security, protection and backup copies of your User Content, which may include, your use of additional encryption technology to protect the Content prom unauthorized access.
Urletter may refuse to store, provide, or otherwise maintain your User Content for any or no reason. Urletter may remove your User Content from the services at any time, if you violate these Terms or if the services are canceled or suspended. If User Content is stored using the services with an expiration date, Urletter may also delete the User Content as of that date. User Content that is deleted may be irretrievable. You agree that Urletter will have no liability of any kind as a result of the deletion of, correction of, destruction of, damage to, loss of or failure to store or encrypt any User Content.
Urletter reserves the right (but shall have no obligation) to remove User Content from the services, in its discretion. You agree to immediately take down any Content that violates these Terms, including pursuant to a takedown request from Urletter. In the event that you select not to comply with a request from Urletter to take down certain Content, Urletter reserves the right to directly take down such Content.
Urletter acknowledges and agrees that it obtains no right, title or interest from you (or your licensors) under these Terms in or to any Content that you create, submit, post, transmit, share or display on, or through, the services, including any intellectual property rights which subsist in that Content (whether those rights happen to be registered or not, and wherever in the world those rights may exist). Unless you have agreed otherwise in writing with Urletter, you agree that you are responsible for protecting and enforcing those rights and that Urletter has no obligation to do so on your behalf.
While we strive to keep our Content accurate, complete and up-to-date, the materials appearing on our website could include technical, typographical, or photographic errors. We do not warrant that any of the materials on its website are accurate, complete or current. We may make changes to the materials contained on our website at any time without notice. However, we do not make any commitments to update the material.
Urletter has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply our endorsement of the site. Use any such linked website at the user’s own risk.
Third Party Content
We may include references or hyperlinks to other websites, content, resources of e-mail content. As Urletter, we have no control over any websites or resources that are provided by companies or persons other than us.
You acknowledge and agree that Urletter is not responsible for the availability of any such external sites or resources, and does not endorse any advertising, products or materials on or available from such websites or resources.
You acknowledge and agree that Urletter is not liable for any loss or damage that may be incurred by you or other users as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such websites or resources.
Third Party Software
We may incorporate certain third party software (“Third Party Software”) that is licensed subject to the terms and conditions of the third party licensing. Nothing in these Terms limits your rights under, or grants you rights that supersede, the terms and conditions of any applicable license for such Third Party Software.
Changes to the Terms
These Terms may be modified from time to time. If there is a change in the Terms, we will inform you via our newsletters on product updates.
By continuing to access to or use us after any modifications become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use Urletter.
